The responsible person in terms of GDPR is the one who others, decides on the purposes and means of processing personal data (such as names, e-mail addresses, etc.).

1.2 What is Personal Data

Personal data is data which disclose or can disclose the customer’s identity. We adhere to the policy of data avoidance. As far as possible, we avoid the collection of personal data.

1.3 Dealings with Personal Data

Personal Data exclusively serves the purpose of establishing a contract, content definition, execution, or processing of a contract agreement (Article 6 I b GDPR). Data is only passed on to third parties for service provision and fulfillment of the contract. We refer to third party providers below.

5. User Forum

The LRTimelapse user forum on https://lrtimelapse.com/ provides a platform for support and user communication. If you don’t register as a user, we will only store minimal data as described in 1.5.

If you subscribe as a forum user, we will only collect your user name, email and IP address, which are required to run the service. When signing in, you will be able to review and set your account preferences, by default they will be set to maximum privacy standards.

When writing a new post, we will collect the time of your post, your username and IP-address.

You also have the option to get notified by email about new topics and/or posts. We don’t use a double opt in here, since you will have to be a registered forum user to be able to use this feature.

You can sign off any of those notifications at any time by clicking the unsubscribe link in the footer of any of those emails. You can as well send us an informal message to the email address provided on the top of this page.

The legal basis for collection and processing this data is our legitimate interest in answering your questions and providing a platform for the exchange of timelapse related discussions in accordance with Art. 6 §1 lit. f GDPR.

6. Comments

If you use the comment function on our website, in addition to these comments, the time of creation, your chosen pseudonym and temporarily also your IP address will be saved. This is done so that we can enforce our rights in the case of unlawful content (Art. 6 §1 f GDPR).

You also have the option to subscribe to comments. If you choose this option, we use the so-called double opt-in method. This means that you will receive a confirmation email asking you to confirm by clicking on a corresponding link that you would like to receive future comments.

You can unsubscribe from the newsletter at any time via the dedicated unsubscribe link in the footer of the newsletter or by sending us an informal message to the email address provided in the imprint. The legitimacy of the already completed data processing operations remains unaffected by the revocation.

8. Data processing when opening a customer account and for contract execution

According to Art. 6 §1 lit. b GDPR, personal data will be collected and processed when you provide us with information when carrying out a contract or when opening a customer account. Which data is collected, can be seen from the respective input forms. A deletion of your customer account is possible at any time by sending a request to address in the header of this document. We only save and use the information provided for the execution of the contract. After completion of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial retention periods and deleted after expiration of these periods, unless you have expressly consented to further use of your data or a further use of that data is legally permitted.

9. Data processing for order handling

In order to process your order, we work together with service providers who support us wholly or partly in the execution of closed contracts. Personal data will be transmitted to these service providers as explained in the following.

The personal data collected by us will be passed on to the transport company commissioned with the delivery (i.e. DHL) within the scope of the contract, insofar as this is necessary for the delivery of the goods. We will pass on your payment details as part of the payment process to the commissioned bank or Paypal as a payment service provider, if this is necessary to process the payment.

All PayPal transactions are subject to the PayPal Privacy Policy.

The legal basis for the transfer of the data is Art. 6 §1 lit. b GDPR.

10. Services by Third Parties

10.1 Google Analytics

This website reserves the right to use Google Analytics, a web analysis service by Google Inc., operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”) and might raise and save data through this web analysis service from which user profiles are created through the use of pseudonyms. For our “social links” we use the so-called Shariff buttons, which do not forward user data to the social media platforms when the page is accessed.

Our website uses the Lazy Load for Videos plugin whenever a video is being embedded. This plugin prevents user data from being sent to the video platforms, if you don’t play the video back at all.

Only when you click on the video, the regular Youtube or Vimeo player will be loaded.

If you click on any of our embedded or linked YouTube or Vimeo videos, you will be connected to the corresponding servers. This tells those servers from which site your are triggering the playback of that video. Additionally, if you are logged in to your YouTube or Vimeo account, you enable the corresponding service to assign the video playback to your personal profile. You can prevent this from logging out of your YouTube or Vimeo account.

If a Youtube or Vimeo video is played back, the provider uses cookies that collect information about user behavior. Anyone who has disabled the storage of cookies for the Google Ad program will not have to expect such cookies when watching YouTube videos. Youtube and Vimeo also store non-personal usage information in other cookies. If you want to prevent this, you must block the storage of cookies in the browser.

Additionally, Vimeo calls the tracker Google Analytics in the iframe, in which the video is called up. This is a separate tracking on vimeo’s side, to which we have no access. You can prevent Google Analytics tracking by using the opt-out tools that Google offers for some Internet browsers. You may also prevent the collection of Google Analytics-generated data related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing a browser plug-in.

The use of YouTube and Vimeo is in the interest of an attractive presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 §1 lit. f GDPR.

In order to provide a powerful search feature, that covers both, the content on LRTimelapse.com and on the User Forum, we use Google Custom search, operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). To provide as few data as possible to Google, we run it with the option “personalizedAds=false”, which prevents Google to use cookies to track your surf behavior and deliver personalized Ads to you. However, the search bar will contact Google on every page load which will transmit some technical data, including your ip address.

The use of the Google Custom Search is in the interest of an attractive presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 §1 lit. f GDPR.

We place affiliate and advertising links or banners for certain third-party providers on our website. With these links/banners, we generate revenues, if you purchase something from out partner via our affiliate-link. The third-party provider can use cookies to be able to locate the origin of the orders and assign it to our affiliate account. However, this does not affect the use of our website and, in particular, does not constitute a purchase obligation.

11.Duration of Storage

We store your personal data beyond the end of the purpose for which the data was raised, but only for the length of time which is required based on legal regulations (esp. fiscal tax law).

After the deadline, the corresponding data is routinely deleted, if it is no longer required to fulfill the contract or to initiate a contract and/or no legitimate interest in the re-storage persists on our part.

12. Your Rights

12.1 Information

You can require information from us whether we process your personal data and as far as this is the case, you have the right to information of these personal data and the additional information mentioned in Article 15 GDPR.

12.2 Right to Correction

You have the Right to Correction of the incorrect personal data relating to you; you can demand the completion of incomplete personal data according to Article 16 GDPR.

12.3 Right to Deletion

You have the Right to demand from us to immediately delete your personal data referring to you. We are required to delete them immediately, especially for one of the following reasons:

  • Your personal data are no longer necessary for the purpose for which they were raised or were processed otherwise.
  • You revoke your permission which was the basis for processing your data, and an otherwise legal basis for the processing does not exist.
  • Your data were processed illegally.

The Right to Deletion does not exist if your personal data relating to you are required for enforcement, execution, or defense of our legal claims.

You have the Right to require from us the Limitation of Processing of your personal data, if

  • we no longer require the data, you, however, require them for enforcement, execution, or defense of legal claims,
  • you filed an objection against the processing of your data, and it is not clear yet, whether our warranted reasons outweigh your reasons.

12.5 Right to Transferability of Data

You have the right to receive the relevant data pertaining to your person provided to us by you in a structured, common and machine-readable form, and you have the Right to transfer this data towards another person responsible without hindrance from us, as far as the processing is based on a permission or a contract, and our processing takes place with the help of automatized processes.

12.6 Right of Cancellation

You have the right to revoke your consent to the processing of data at any time with future effect. In the case of withdrawal, we will delete the data concerned immediately, as far as further processing can not be based on a legal basis for consentless processing. The revocation of consent does not affect the legality of the processing carried out on the basis of the consent until the revocation.

12.7 Right of Appeal

Without prejudice to any other administrative or judicial remedy, you have the right to complain to a supervisory authority, in particular in the Member State of its residence, place of work or place of alleged infringement, if you believe that the processing of your personal data against DS GMO violates.

The supervisory authority to which the complaint has been submitted shall inform the complainant of the status and results of the complaint, including the possibility of a judicial remedy under Article 78 of the GDPR.
